    What is SATOP?

Substance Abuse Traffic Offender Program or also known as SATOP consists of an evaluation and classes that you are required to take in order to get your driver’s license reinstated. If you received a DWI in the State of Missouri and had your license suspended due to that DWI, you will be required to take SATOP before you can get your license back. If you accept a plea bargain in your DWI charge, you will more than likely being agreeing to take SATOP before your license is eli

Charge and Defense: Missouri Auto Theft

The terms theft and stealing seem to go hand in hand in the State of Missouri. Missouri Revised Statute § 570.030 describe the laws relating to robbery, stealing, etc. Here, we’ll be discussing the charge of Auto Theft and what possible defenses may be available. Generally, theft makes it illegal to take another property without their permission. In order for the State of secure a conviction for auto theft it must prove, beyond a reasonable doubt, the defendant took another

In The News: Mistrial For Man Who Killed Homeless Man

September 12 2012, Willie C. Robertson fired two shots at a homeless man, Archie Lee “Rabbit” McElroy. One of the two shots struck Archie in the chest, killing him. Hours after shooting Archie, Robertson called the police and confessed on a 911 tape that he killed Archie. Robertson was charged with first-degree murder and armed criminal action. Five years after the shooting, Robertson had his day in court where a jury couldn’t make a determination as to Robertson’s guilt. St.

Revenge Porn Soon To Be Against The Law in Missouri.

Missouri currently has a bill in the legislature that will make revenge porn against the law in the State of Missouri. What is Revenge Porn? While the term revenge porn seems very self explanatory, the term can also be misleading. The typical scenario is where two people are in a relationship and they send each other explicit photographs or videos, they break up and the scorned party uploads those photographs or videos to the internet. While this is the most notable way of re

Celebrating Too Much: 4th of July DWI

With the 4th of July holiday coming up, make sure you are not one of the many St. Louis residents who will be arrested for a DWI over the holiday weekend. This year the 4th of July is on a Tuesday, throwing a kink in all of our party plans! Hopefully, your boss is nice enough to give you Wednesday off to recover, but with the holiday being on Tuesday you will more than likely have a long weekend filled with friends, family and alcohol. That being said, if you’re driving, don’

In The News: Text Messages Could Lead to Manslaughter

This case doesn’t come out of Missouri, but it’s such an interesting case, I’d be remissed if I didn’t mention it in our In The News section because frankly, it’s big news! This is a case out of Taunton, Massachusetts where Michelle Carter was accused and found guilty of involuntary manslaughter for sending text messages to a friend, whom committed suicide based on the text messages Ms. Carter sent him. Ms. Carter will be sentenced August 3, 2017 and now faces up to 20 years

When Do You Need to Identify Yourself to a Police Officer in Missouri?

I’ve seen a ton of Facebook videos where a person is stopped by a police officer and the person stopped argues with the officer over whether or not that person is required to give the police officer his or her identification. Like any good legal answer, it depends. Let’s take a deeper look into when you are required to and when you are necessarily required to identify yourself to a police officer. First off, the Fourth Amendment to the United States Constitution gives the “ri

Charge and Defense: Missouri Statutory Rape

This is the first posting for a new blog article series called Charge and Defense, where I will go into greater detail on certain crimes, the elements of that crime and the possible defenses. To kick off our first posting, we’ll be discussing the charge of statutory rape in the State of Missouri. The Charge In Missouri, statutory rape is defined as rape in the first degree (RSMO § 566.032) and rape in the second degree (RSMO § 566.034). First Degree Statutory Rape A person co

The DWI Process in Missouri. Part 3: The Field Sobriety Test.

By this time, the officer has asked you to step out of the vehicle and is asking if you’d submit to a field sobriety test. Unlike the request to get out of the vehicle, the officer’s request for you to submit to a field sobriety test if literally a request. You are not required to take a field sobriety test. Regardless of what the officer tells you, if you refuse to take the field sobriety test, there will be no legal consequences. Don’t take legal advice from a police office
